INTRODUCTION

This page contains the terms and conditions on which I supply the products listed on my website Folly Flora to you. These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions in full.  If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website. Upon accepting your order I Christine Baker/Folly Flora and you (The Customer) are legally bound by these terms and conditions. 

ORDERING

This shop displays goods which are advertised for sale and gives information about them. By advertising goods we are inviting you to place an order. If you place an order, we are not obliged to accept that order and the contract between us will only be formed if and when we accept your order. Our acceptance of your order and the formation of a binding contract between you and us will take place when we dispatch the goods to you. Up until this point, there will be no contract in place between you and us, which means that neither you nor we will have any rights against or obligations towards the other, until the order is dispatched.

Please use our online shop to place your order. Shipping to the UK full addresses only.

No contract will exist until I receive full payment from you. Full payment is required before your order is accepted and dispatched. It is your responsibility to ensure the information and full address you provide is accurate, please ensure you check all details before placing your order. 

PAYMENT

Folly Flora accepts payments via Stripe, a trusted and secure electronic payment gateway.

You do not need a  account in order to make a purchase, and you can use your debit bank card when checking out if preferred. If you wish to pay directly via online bank transfer please get in touch via the 'CONTACT' page.

AVAILABILITY of PRODUCTS

I only list items on Folly Flora that are available and in stock to fulfil your order. 

If I (for unforeseen circumstances such as illness or for whatever other reason) cannot deliver the products that you have ordered within 28 days of your order I will contact you.

I will then cancel your order and issue a full refund.

PROCESSING of ORDERS

Your order will be processed and delivered no later than 28 days after your order has been placed under 'The Consumer Contracts Information, Cancellation and Additional Charges Regulations 2013' requirements. 

Usually the dispatch of your order will take place within 2-5 working days. I delay packing an order for 24 hours to allow time for a change of mind or change of order details. Orders are packaged and posted from the second day onwards. I will notify you by email after the order has been accepted at the Post Office and is 'on its way to you'. 

DELIVERY

Delivery for orders over £30 is FREE, shipping to UK full addresses including post code only.

N.B. Some very large or fragile items too difficult to package and post safely, are exempt from the Free or Standard Delivery Charge and are for 'Collection in Person only' as clearly stated in the product details.

I use Royal Mail 2nd Class Large Letter and Small/Medium Parcels categories. 

Please allow up to 7 working days (or more, not guaranteed) for delivery following the 'dispatch of your order' email notification.

Delivery will be generally be within 3-7 working days but the these estimated delivery times cannot be guaranteed by either Royal Mail or Folly Flora. Delayed and late deliveries due to circumstances beyond my control may occur (eg. busy Christmas or during and after Royal Mail strike periods).

Please check to ensure you have given a full postal/delivery address with correct post code.. I cannot be held responsible for parcels going astray if the delivery address supplied by you is incorrect. 

DAMAGED PARCEL/GOODS

I take care in packaging the items to ensure that they arrive with you safely. 

However, in the event that your items do arrive damaged please contact me preferably within 24/48 hours of receipt via email on the 'CONTACT' page. If the damage is clear when the postman/postwoman delivers the parcel please ask them to make a note of the extent of the breach in packaging in their details to help verify a claim for damage. 

To assist me in processing a claim with Royal Mail I kindly request that you take photos of any damage to the outer packaging before you open it, the broken/damaged item in situ (if possible) and the broken/damaged product itself. Please retain the packaging in case Royal Mail require evidence of the damage during the claim procedure. These photos are needed to provide legal evidence of a damaged item. Without them I may not be able to make a valid claim from the delivery service.

If I require the return of the damaged or defective goods I will refund you the cost of returning them, please contact me first to discuss/authorise the return. I would advise that you use a Royal Mail delivery service to return your goods. Evidence of 'Proof of Postage must be obtained when returning goods, this will also be submitted to Royal Mail during the claim procedure.

INCORRECT GOODS

If I delivered the item to you in error I will refund you the cost of returning the goods. In the first instance please contact me to discuss/authorise the return. I would advise that you use a Royal Mail delivery service to return your goods. Evidence of Proof of Postage/Certificate of Posting (free from post office counter staff at time of posting) must be obtained when returning goods.

CANCELLATION of ORDER

All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations 2013.

Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive delivery of your goods. To meet the cancellation deadline, please notify me via email of your wish to cancel the order before the cancellation period has expired.

A Withdrawal and Cancellation Form (or also known as Cancellation and Returns Form) is provided for you to use if you find it helpful. This is found at the end of the 'INFORMATION' page. Copy and paste the form into an email if you wish to use it.

Once you have notified me that you wish to cancel the order, any sum debited to me will be refunded to you as soon as possible and in any event within 14 days of your cancellation if goods have not yet been dispatched.

Exceptions to your right to cancel are goods that are custom orders made to the customers specification or are clearly personalised, (if work has already started on making/personalising the item).

RETURNS 

For goods already received, you have 14 days from delivery to notify Folly Flora if you wish to cancel or return your order. The cancellation period of 14 days will start the moment the customer receives the order. 

Please use the 'RETURNS FORM' at end of 'INFORMATION' page (copy and paste into an email) if you wish.

Dispatch item back to Folly Flora within 30 days of delivery.

All goods must be returned in their original condition. Once you have received the goods you have a duty to retain and take reasonable care of them. Please return items intact and unused, still in their original protective coverings or cellophane wraps, with all tags and labels still attached.
To avoid items being damaged in the post I would recommend that you re-use the original packaging if it is still intact. Returned goods must be packaged with sufficient care to ensure that damage does not occur during transit. I cannot be held responsible for damage to returned goods caused by insufficient packaging. If the item is not returned in its original resalable condition, the buyer is responsible for any loss in value and a partial refund will be given.
Buyers are responsible for all return shipping costs.
Please obtain a 'Proof of Postage/Certificate of Posting' (free from the Royal Mail/post office counter staff) when you post the item or use a trackable method if you prefer.

REFUNDS

A refund will be issued within 14 days of Folly Flora receiving the returned item (as per the conditions set out in the 'RETURNS' section above) or evidence (a certificate of posting/tracking from Royal Mail when you post the item) that the item has been posted back. Buyers are responsible for all return shipping costs. Please remember to obtain a Certificate of Posting from Royal Mail/tracking details when you post the item.

The refund will be issued using the same means of payment used for the initial transaction, either by Stripe or Bank Transfer.

LAW and JURISDICTION

These terms and conditions are governed by English law.  Any dispute arising in connection with terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales
